Terms and Conditions of Sale

1. Seller

Elyps is operated by Osium Tech LLC, a New Mexico Domestic Limited Liability Company located at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA. Contact: contact@elyps.run.

2. Service

Elyps is a digital race-planning tool providing route analysis, estimates, checkpoints, nutrition, equipment, assistance and race-day documents. Results are indicative and are not medical advice or a guarantee of performance or safety.

• A free plan with limited features.
• A paid plan with the features displayed on the pricing page at checkout.

3. Price and payment

Plans, prices, currency, billing period and any discounts are those displayed on the pricing page and in the order summary before purchase. Payment is processed by a secure payment provider; Elyps does not store full card details.

Osium Tech LLC currently does not charge VAT. Any tax legally due based on customer location will be displayed before purchase.

4. Start and renewal

Access begins immediately after payment confirmation. Subscriptions automatically renew according to the selected billing period until cancelled, and the customer authorizes the payment provider to charge the saved method at renewal.

5. Cancellation

Customers may cancel at any time using the easily accessible online feature in their account. Cancellation stops the next renewal; paid access remains through the paid period unless mandatory law provides otherwise. Account deletion and subscription cancellation are separate.

6. Withdrawal

Consumers may notify withdrawal without giving a reason no later than fourteen calendar days after the exact date and time of purchase. A request received after that deadline no longer qualifies for the statutory withdrawal right unless more favorable mandatory law applies. If immediate access is expressly requested, the consumer may owe the portion already supplied. Early loss of this right only occurs where legally permitted and after appropriate express consent.

• A reason may be provided voluntarily but is never required.
• Any refund due is issued within fourteen days via the original payment method unless otherwise agreed.

7. Availability

Elyps aims for reasonable availability but does not guarantee uninterrupted or error-free operation. Maintenance, incidents, third parties or force majeure may interrupt access. Material adverse changes to an ongoing subscription will be notified where required.

8. Liability

Users remain responsible for sporting, medical, logistical and safety decisions and must verify organizer information, weather, cut-offs, mandatory gear and trail conditions. Nothing limits mandatory consumer rights or liability that cannot legally be excluded.

9. Complaints and mediation

Complaints must first be sent to contact@elyps.run. If a dispute remains unresolved, a consumer mediator will be appointed to seek an amicable solution.

10. Governing law

These terms are governed by New Mexico law without depriving consumers of mandatory protections in their country of residence. Competent courts are determined by applicable mandatory rules.
